LAYYAR MUTANE BIYU ZUWA SAMA DA DABBA DAYA(Dr Ibrahim Jalo Jalingo)


‘Yan’uwa masu daraja! Wannan
mas’ala ana kiran ta mas’alar
“Mutane da yawa su hada kudi su
sai dabba daya saboda su yi
Hadaya da ita ko kuwa su yi Layya
da ita”.
To Maluman Musulunci suna da
kauli biyu cikin mas’alar:-
Kaulin farko: Yana halatta mutum
biyu har zuwa bakwai su hada kudi
su sai rakumi guda, ko saniya guda
su yi hadayarsu da ita, ko su yi
layyarsu da ita.
Wannan ita ce mazhabar mafi
yawan malaman Musulunci:
Hanafiyyah, da Shafi’iyyah, da
Hambaliyah, da Zahiriyyah, da
sauransu.

na 904, da Imamun Nasaa’ii hadithi
na 4,398, da Imamut Tabraaanii
hadithi na 6,432, da Imamul
Baihaqii cikin As-Sunanul Kubraa
hadithi na 19,710 daga Sahabi
Jabir Dan Abdullahi ya ce:-
((ﺧﺮﺟﻨﺎ ﻣﻊ ﺭﺳﻮﻝ ﺍﻟﻠﻪ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ ﻭﺳﻠﻢ
ﻣﻬﻠﻴﻦ ﺑﺎﻟﺤﺞ ﻓﺎﻣﺮﻧﺎ ﺭﺳﻮﻝ ﺍﻟﻠﻪ ﺻﻠﻰ ﺍﻟﻠﻪ ﻋﻠﻴﻪ
ﻭﺳﻠﻢ ﺍﻥ ﻧﺸﺘﺮﻙ ﻓﻲ ﺍﻹﺑﻞ ﻭﺍﻟﺒﻘﺮ ﻛﻞ ﺳﺒﻌﺔ ﻣﻨﺎ ﻓﻲ
ﺑﺪﻧﺔ )).
Ma’ana: ((Mun fita tare da Manzon
Allah mai tsira da amincin Allah
muna masu daga murayarmu da
yin talbiyyar aikin Hajji, sai Manzon
Allah mai tsira da amincin Allah ya
umurce mu da yin tarayya cikin
Rakuma, da Shanu, dukkan mutum
bakwai cikinmu rakumi daya ko
saniya daya)). Intaha.
Kauli na biyu: Ba ya halatta mutum
biyu zuwa sama su hada kudi su
sai rakumi daya ko saniya daya
domin su yi Hadayar wajibi ko
hadayar nafila da ita, ko domin su
yi Layya da ita.
Wannan shi ne Mash’huurin zance
cikin Mazhabar malamanmu na
Malikiyyah.

A gaskiya malumanmu na
Malikiyyah ba su da wata ayah, ko
wani hadithi da ya yi nassi a kan

wasunsu sun ce madogararsu cikin
wannan mazhaba ita ce: Fadar
Allah Madaukakin Sarki:-
((ﻳﺎ ﺃﻳﻬﺎ ﺍﻟﺬﻳﻦ ﺍﻣﻨﻮﺍ ﻻ ﺗﻘﺘﻠﻮﺍ ﺍﻟﺼﻴﺪ ﻭﺍﻧﺘﻢ ﺣﺮﻡ
ﻭﻣﻦ ﻗﺘﻠﻪ ﻣﻨﻜﻢ ﻣﺘﻌﻤﺪﺍ ﻓﺠﺰﺍﺀ ﻣﺜﻞ ﻣﺎ ﻗﺘﻞ ﻣﻦ
ﺍﻟﻨﻌﻢ ﻳﺤﻜﻢ ﺑﻪ ﺫﻭﺍ ﻋﺪﻝ ﻣﻨﻜﻢ ﻫﺪﻳﺎ ﺑﺎﻟﻎ ﺍﻟﻜﻌﺒﺔ….)
).
Ma’ana: ((Ya ku wadanda suka yi
imani kada ku kashe farauta alhali
kuna masu harama. Kuma wanda
ya kashe shi daga cikinku bisa
ganganci, sai ya bada sakayyar
misalin abin da ya kashe, cikin
dabbobin ni’imah, masu adalci biyu
daga cikinku ne za su yi masa
hukunci, a matsayin wata hadaya
mai zuwa Dakin Ka’abah…)).
A nan sai suka ce: Tun da Allah ya
wajabta wa mai kashe farauta
bayar da misalin a bin da ya kashe
cikin dabbobin gida na ni’imah
wanda za a kai har Ka’abah a
matsayin hadaya, ke nan idan
muka halattar da haduwar mutum
bakwai a kan rakumi ko saniya
daya, wannan zai kai mu ga cewa:
ko wanne daga cikinsu ya yi
hadaya ne da kashi daya cikin
bakwai na rakumin ko na saniyar!!
Wanda kuma ya fitar da kashi daya
kawai cikin bakwai na rakumi ko
saniya, to lalle wannan bai bayar
da misalin dabbar farauta da ya
kashe ba!!.
A gaskiya wannan hujja da sashin
malamanmu na Malikiyyah suka
fada, lalle yin Kiyasi ne domin
kalubalantar hukuncin da nassi ya
zo da shi karara, wannan kuwa
abu ne da sam bai dace ba. Allah
ya shiryar da mu zuwa ga abin da
yake daidai har kullum.
SAHIHIN HUKUNCI CIKIN
MAS’ALAR:
Sahihiyar magana cikin wannan
mas’ala ita ce: Halal ne mutum
bakwai su hada kudi su sai rakumi
daya ko saniya daya, domin su yi
Hadaya da shi ko kuwa Layya da
shi. Wallahu A’alam.
