BAMBANCIN DA KE TSAKANIN
SHUGABANNIN MAZHABOBI WAJEN
HANYOYIN DA SUKE DOGARO DA
SU (2)
MAZHABAR IMAMU ABU HANIFA:
Imamu Abu Hanifa ya wanzu a
matsayin misali na hanyar fitar da
hukunce-hukunce, wanda ya saba
da hanyoyin shugabannin
mazhabobi guda uku. Saboda haka
qa’idojin mazhabarsa kamar yadda
shi da kansa ya bayyana, sun
taqaita ne cikin fadarsa, “Ni ina yin
riqo ne (watau tabbatar da
hukunci) da littafin Allah, idan
kuma ban sami nassi a cikinsa ba
sai na dauka daga Sunnar Manzon
Allah (S.A.W.) da maganganun
Sahabbai masu inganci, wadanda
suka yadu a hannun amintattu.
Idan kuma ban sami nassi a littafin
Allah da Sunnar ManzonSa ba, sai
na dauki maganar Sahabbansa,
kuma ina daukar maganar wanda
na so daga nan ba zan saki
maganarsu ba, na kama ta
waninsu. Idan kuma lamarin ya ci
tura zuwa Ibrahimu, da Sha’abi, da
Ibnul Musayyib, (ya lissafa
wadansu mazaje), sai ni ma na yi
Ijtihadi kamar yadda suka yi.”
Wadannan su ne manyan ginshiqai
na mazhabar Abu Hanifa. Akwai
kuma wadansu ginshiqai na reshe
masu daraja ta biyu, wadanda suka
haihu daga wadannan, ko kuma
suke komawa garesu. To daga irin
wadannan ginshiqai ne na reshe
sabani yake bayyana, kamar
fadarsu, tabbacin nunin lafazi mai
gamewa dai dai yake da lafazi
kebantacce, da fadarsu mazhabar
Sahabi a kan Sahabi “Umumi” abu
ne da yake kebance wannan
“Umumin da fadarsu, “Yawan
maruwaita ba ya fa’idantar da
rinjaye,” da fadarsu, “Rashin
la’akari da mafahumin sharadi da
sifa da na rashin karbar Hadisin
mutum daga cikin abin da yake da
wahala a kauce masa da cewa
umarni yana tabbatar da wajibci ne
matuqar ba a sami abin da zai
kawar da wajibcin ba.” Idan
maruwaicin Hadisi kuma masanin
fiqihu ya aikata abin da ya saba da
ruwayarsa, to za a yi aiki ne da
abin da ya aikata, ba da abin da ya
rawaito ba.” Wato a gabatar da
qiyasi “Jaliyyi” (bayyananne) a kan
Hadisin mutum daya, da ya yi karo
da shi; ko riqo da “Istihsani” da
barin qiyasi a lokacin da buqatar
hakan ta bayyana. Saboda haka ne
suka samo daga fadar Imamu Abu
Hanifa, “Mun san cewa wannan
ra’ayi ne kuma shi ne mafi kyawun
abin da muka sami ikon wanzarwa,
idan kuwa wani ya zo mana da
abin da ya fi shi, sai mu karba.”
