HUKUNCIN MASU CIKI KO MASU SHAYARWA IDAN SUKA KASA YIN AZUMIN RAMADAN(Dr. Ibrahim Jalo Jalingo)


1. Farko dai: Maluman Musulunci sun yi Ittifaqi a kan cewa mace mai ciki da wacce take shayarwa idan suka ji tsoron cutuwar kansu, ko cutuwar kansu tare da cutuwar ‘yan’yansu, to, suna da daman su bar yin azumin Ramadan, sannan daga baya su biya, babu kuma wata ciyarwa a kansu bayan biyan.

2. Abu na biyu: Su Malaman sun yi sabani game da: Idan ita Mai cikin, da Mai shayarwar suka ajiye azumi saboda tsoron kada ‘yan’yansu su cutu, ba wai kada su su cutu ba. Sun yi sabani cikin wannan Mas’alah har zuwa kauli shida:

– Kaulin farko: Mai ciki da Mai shayarwa idan suka sha ruwa saboda tsoron kada ‘ya’yansu su cutu, ba wai saboda su kansu su cutu ba, babu ciyarwa a kansu sai dai biya kawai. Wannan shi ne mazhabar Hanafiyyah. Da wasu Taabi’ai da Taabi’ut Taabi’in.

– Kauli ba biyu: Ita mai ciki za ta biya ba tare da ciyarwa ba, amma mai shayarwa za ta biya, sannan kuma za ta ciyar. Wannan shi ne mazhabar Malikiyyah. Kuma wannan shi ne mazhabar Laith Bin Sa’ad.

– Kauli na uku: Da mai cikin da mai shayarwan dukkansu za su biya kuma za su ciyar. Wannan shi ne mazhabar Shaafi’iyyah, da Hambaliyyah. Kuma wannan wata fatawa ce da aka ruwaito daga wasu Sahabbai da Taabi’ai.

– Kauli na hudu: Da mai cikin da mai shayarwar ciyarwa kawai za su yi babu biya a kansu. Wannan ita ce fatawar da aka ruwaito daga Abdullahi Bin Abbas, da wasu Taabi’ai.

– Kauli na biyar: Da mai cikin da mai shayarwar babu biya ko ciyarwa a kansu. Wannan shi ne mazhabar Ibnu Hazam daga cikin Zahiriyyah.

– Kauli na shida: Mai ciki da Mai shayarwa in sun ga dama su ciyar ba tare da biya ba, in kuma sun ga dama su biya ba tare da sun ciyar ba. Wannan shi mazhabar Ishaq Bin Raahuyyah.

MAGANAR DA MUKA RINJAYAR:
Mun rinjayar da Mazhabar Hanafiyyah, da fatawar Taabi’ai da yawa, da sauran Malaman da ke tare da su na cewa: Mace mai ciki da wacce take shayarwa idan suka sha ruwa saboda hana cutuwar ‘yan’yansu ba wai saboda hana cutuwar kanunsu ba, to za su biya ne kawai, ba za su ciyar ba.
Mun rinjayar da wannan mazhaba ne saboda hadithi na 715 da Tirmiziy ya ruwaito da isnadi sahihi daga Sahabi Anas Bin Malik Allah Ya kara masa yarda, ya ce: Manzon Allah mai tsira da amincin Allah ya ce:-
((ان الله تعالى وضع عن المسافر الصوم وشطر الصلاة وعن الحامل او المرضع الصوم)).
Ma’ana: ((Lalle Allah Madaukaki Ya sauke wa Matafiyi yin azumi da kuma rabin Sallah, Ya kuma sauke wa Mai ciki da Mai shayarwa yin Azumi)).
Makamar hujja cikin hadithin shi ne: An hada matafiyi da mai ciki da mai shayarwa cikin wannan hadithi a kan hukunci guda; watau sauke musu azumi. To da yake nassi ya zo da cewa shi matafiyi zai biya azumin bayan Ramadan, sai mu kiyasta Mai ciki da Mai shayarwa a kan shi matafiyin, saboda haka su ma sai mu ce: za su biya abin da suka sha bayan Ramadan ba tare da sun ciyar ba.

ABIN LURA A NAN:
Abin lura a nan shi ne: A dai iya sanina babu wani ingantaccen nassi daga Manzon Allah mai tsira da amincin Allah cikin wannan Mas’alar. Allah Ya taimake mu. Ameen.
