MUTUMIN DA KE DA MATA 4 SANNAN YA YI WA DAYANSU YANKAKKEN SAKI KO ZAI HALATTA YA AURI WATA MATAR KAFIN IDDAR WANNAN TA CIKA?(Dr. Ibrahim Jalo Jalingo)


1. Babu sabani tsakanin Malamai cewa: ba ya halatta ga namiji ya hada Ya da Kanwa karkashin aurensa a lokaci guda. Haka nan ba ya halatta gare shi ya daura wa mace ta biyar aure koda kuwa akwai wacce ya saka saki na kome matukar dai ba ta gama iddarta ba. Wannan mas’ala babu sabani a cikinta tsakanin Malaman Sunnah; saboda dalilai da yawa daga cikinsu akwai: Fadar Allah cikin surar Nisaa’i aya ta 23 ((Kuma kada ku hada tsakanin Ya da Kanwa saifa abin da ya riga ya wuce)). Da kuma wasu hadithan Annabi mai tsira da amincin Allah, daga cikinsu akwai hadithi na 2243 da Imam Abu Dawud ya ruwaito, da hadithi na 1952 da Imam Ibnu Majah ya rueaito, da hadithi na 4631 da Imam Ahmad ya ruwaito, da hadithi na 4156 da Imam Ibnu Hibban ya ruwaito dukkansu da isnadi sahihi cewa Sahabi Wahb Al-Asadiy ya musulunta alhalin yana da mata 8 sai Annabi mai tsira da
amincin Allah ya ce da shi ya zabi 4 kawai daga cikinsu. Haka nan ya faru da sahabi Gailan Bin Salamah, haka nan ya faru da sahabi Qais Bin Al-Harith.
2. Amma su Malaman Sunnah sun yi sabani game da idan mai mata 4 ya saki guda a cikinsu saki yankakke watau: saki na 3 ko kuwa sakin Khul’i, ko yana da damar ya daura wa wata matar aure kafin iddar wannan da ya saken ta kare? Akwai mazhabobi biyu na Malamai cikin wannan mas’ala:-
– Hanafiyyah, da Hanabilah sun tafi a kan cewa hakan ba ya halatta matukar dai ba ta gama idda ba tukun. Wannan kuwa shi ne kaulin Aliyyu Bin Abi Talib, da Zaid Bin Thabit, da Mujahid, da Ataa Bin Abi Rabah, da Nakha’iy, da Thauri.
Babbar hujjarsu a nan ita ce qiyasta wacce aka mata saki yankakke a kan wacce aka yi mata saki na kome; saboda ko wacce daga cikinsu wajibi ne a kanta ta yi wa mijin da ya sake ta iddah.
– Amma Malikiyyah, da Shafi’iyyah sun tafi a kan cewa yana halatta ya daura wa wata matar aure kafin iddar wancan ta cika. Wannan kuwa shi ne kaulin Sa’id Bin Al-Musayyib, da Al-Hasan Bin Al-Basriy, da Urwah Bin Az-Zubair, da Ibnu Abi Laila, da Abu Tahur, da Abu Ubaid, da Ibnul Munzir.
Babbar hujjarsu a nan ita ce matar da aka yi mata yankakken saki babu wata alakar aure da ta rage tsakakinta da mijin da ya sake ta, tunda kuwa babu irin wannan alaka ta yiwuwar ya dawo da ita cikin wannan iddah nata, ke nan babu hujjar a ce ba zai iya auren wata matar ba kafin iddar wannan ta kare.
MAZHABAR DA MUKE RINJAYARWA A NAN ITA CE: mazhabar Malikiyyah, da Hambaliyyah; saboda ganin irin bambancin da ke tsakanin yankakken saki da kuma sakin kome, misali:-
1. Mai yankakken saki babu takaba a kanta da wanda ya sake ta zai mutu cikin iddarta. 2. Ba za ta gaji wanda ya sake ta ba, shi ma ba zai gaje ta ba, da dayanasu zai mutu kafin iddarta ya kare. 3. Wanda ya sake ta ba yi da damar ya komar da ita karkashin auransa bayan koda kuwa ba ta gama idda ba. 4. Ba ya halatta gare ta ta bude wani sashi na jikinta a gaba gare shi. 5. Ba ya halatta ta kebanta da wannan da ya sake ta. 6. Ba ya halatta ta yi tafiya da wanda ya sake ta ba tare da wani mahrami nata ba. Allahu A’alamu wa A’ala.
